Is India a Hague Agreement member?
No — India is NOT a party to the Hague Agreement. Foreign design applicants must file directly via an Indian agent.
Paris Convention priority window?
6 months from the first design filing in a Convention country. Certified priority document required.
Locarno classification?
India follows the Locarno classification (currently the 13th edition). One application per class.
Term of protection?
10 years from registration, renewable for a further 5 years (15 years total).
Novelty requirement?
Absolute novelty — the design must not have been published or used anywhere in the world before the priority date.
